Ontario moving ahead with legal challenge of planned federal carbon tax

November 30, 2018 – Ontario is moving forward with its legal challenge of Ottawa’s planned carbon tax, arguing pricing emissions is the jurisdiction of the provinces and not the federal government.

In court documents released today, the Progressive Conservative government says the federal Liberals are trying to impose a form of “unconstitutional disguised taxation.”

The Tory government says the federal tax, which will be imposed on provinces that don’t have their own carbon price in 2019, will raise the cost of living for Ontario residents.

Premier Doug Ford scrapped the province’s cap-and-trade system after winning a majority government in the spring election.

New Brunswick announced earlier this week that it was joining Ontario and Saskatchewan in their legal challenge against the federal government.

Critics have said Ontario’s court challenge will be a costly and will have little chance of success.
